To implement provisions in the agency’s Sunset bill, the Commission has proposed rules to eliminate instructor licensing.  The proposed rules are expected to be adopted at the August Commission meeting with an effective date of September 1, 2019. TREC will continue to approve and renew instructor licenses through August 31, 2019. 

As a reminder, qualifications for instructors have not changed; however, the responsibility to ensure an instructor meets these qualifications will be shifting to the education course provider.  TREC will review instructor qualifications when auditing education providers and courses.  Disciplinary action may be taken against an education provider who fails to sufficiently qualify an instructor before allowing them to teach a course.

Instructors of real estate and inspector continuing education (CE or ICE) elective courses must be competent in the subject matter to be taught and have the ability to teach effectively.

Instructors of real estate and inspector qualifying courses (pre-license) must have:

• a college degree in real estate or inspection and three years of teaching or training experience; or
• five years of active experience as a license holder and three years of teaching or training experience; or
• The equivalent of the above as determined by the provider after consideration of the instructor's professional experience, research, authorship, or other professional endeavors in real estate or inspection.

Instructors of Legal Update I & II must:

• satisfy requirements to teach qualifying courses; and
• complete the Legal Update I & II instructor training and receive a passing grade of at least 80% on the final exams promulgated by the Commission.

Instructors of Real Estate Brokerage and the Broker Responsibility course must:

• have at least five years of experience as an active broker, and
• satisfy the minimum requirements to teach qualifying courses.

Instructors of the Broker Responsibility course must also complete the Broker Responsibility instructor training and receive a passing grade of at least 80% on the final exam promulgated by the Commission. 

Instructors of the Texas Standards of Practice, Standards of Practice Review and Inspector Legal and Ethics must have:

• at least five years of active experience as a Texas professional inspector; and either have
• performed at least 200 real estate inspections as a Texas professional inspector; or
• three years of experience in teaching or sponsoring trainees or inspectors.
