Register a Timeshare Plan
The Texas Real Estate Commission regulates the sale of timeshare interests in Texas. Before you can sell or offer to sell a timeshare interest in Texas, you must register the timeshare plan. Timeshares have a unique set of laws and rules that regulate them.
TREC has a new, completely online process via the Real Estate and Appraiser License Management Portal, although the Texas Timeshare Act provisions have not changed and the application requirements remain the same.
After creating a REALM Portal account, start a timeshare application. Provide the name and the type of timeshare plan and the names and contact information for the Developer, Contact Person, Management Company, Complaint Contact, and Agent for Service of Process (if applicable).
Once the basic information is entered, the application breaks into two paths: a Full Registration or an Abbreviated Registration for those plans already registered in a qualified jurisdiction.
You must upload the required documents listed in the REALM Portal before you can proceed. Sign the application electronically, and pay the required filing fee by credit card. You must also pay the 3% convenience fee required by the Texas Department of Information Resources (DIR).
After your application and required fees are submitted and accepted by TREC, we will review the application materials and will communicate with the Contact Person via email as soon as reasonably possible if the timeshare plan has been registered or if changes or additional information are needed.
An application will be considered void if the required documents or additional information requested by TREC are not received within 60 days after the request. Please contact us at 512-936-3005 or email if you have any questions.
